The Superintendence of Industry and Commerce Strikes Again

This time the company BODYTECH was sanctioned with a fine of USD$50,150. The reason, incomplete, unclear and confusing information given to the consumers.   Concerning the distance sales by telephone, BODYTECH was not granting the consumers enough information regarding the terms of the contract, the price, the existence of the rights of withdrawal and reversion, nor the term to exercise them.   Furthermore, the contracts included conflicting information. Concerning the duration, the contract initially states that it is indefinitely, however it further establishes, that the term may be renewed for an equal or different term by executing a new affiliation contract.   The decision is not final as it is subject to appeal, nonetheless, the evidence gathered within the proceeding is strong enough to support the fine.
